Chapter I<\/center><\/h1>

<\/p>\n

General Dispositions<\/b><\/center>Article 1
\nScope of Application<\/h4>

  1. O presente regulamento cont\u00e9m as disposi\u00e7\u00f5es fundamentais a observar na utiliza\u00e7\u00e3o dos ancoradouros para amarra\u00e7\u00f5es fixas de embarca\u00e7\u00f5es de recreio no porto de Set\u00fabal: denominado de \u201cSoltr\u00f3ia\u201d concessionado e operacionalizado pela Comporta Pier, Lda.<\/li>\n
  2. This regulation applies to all users of the services provided at the aforementioned anchorage.<\/li>\n
  3. Service users are considered to be all persons who have requested these same services and who have settled the respective payment.<\/li>\n<\/ol>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><\/div><\/div><\/div>

    <\/p>\n

    Article 2
    \nValidity of parking at the mooring<\/b><\/center><\/h4>
    <\/div>\n\t
    \n\t\t
    \n\t\t\t
      \n
    1. The parking permit at the mooring is valid only for the holder and for the vessel to which it relates.<\/li>\n
    2. Est\u00e1 vedado aos utentes a utiliza\u00e7\u00e3o da amarra\u00e7\u00e3o que lhes esteja atribu\u00edda, por embarca\u00e7\u00f5es diferentes daquela a que a mesma respeita, ainda que tais unidades sejam sua propriedade, sem autoriza\u00e7\u00e3o pr\u00e9via da Comporta Pier.<\/li>\n
    3. Whenever a vessel, registered for the use of a mooring, belongs to more than one person, Comporta Pier Lda. will require that, before it, one of the co-owners assumes sole responsibility for said use, without prejudice to the general rules of law applicable to co-ownership.<\/li>\n<\/ol>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><\/div><\/div><\/div>

      <\/p>\n

      Article 3
      \nAssignment of berths<\/b><\/center><\/h4>
      <\/div>\n\t
      \n\t\t
      \n\t\t\t
        \n
      1. Os servi\u00e7os administrativos da Comporta Pier, recebem as inscri\u00e7\u00f5es para a utiliza\u00e7\u00e3o de postos de amarra\u00e7\u00e3o no ancoradouro denominado de \u201cSoltr\u00f3ia\u201d, para a \u00e9poca anual do ano em curso, tr\u00eas fases\/per\u00edodos um para as inscri\u00e7\u00f5es para \u00e9poca, depois ser\u00e1 seguido do per\u00edodo para inscri\u00e7\u00f5es de per\u00edodos de Trimestre e Mensais, sendo depois aceites por ordem de chegada final da \u00e9poca:\n
          \n
        1. a partir das 10h do dia de 28 abril at\u00e9 \u00e0s 23:59h do dia 30 abril do ano corrente, para as inscri\u00e7\u00f5es para toda a \u00e9poca Junho a setembro 2026;<\/li>\n
        2. a partir das 10h do dia de 1 de Maio at\u00e9 \u00e0s 23:59h do dia 8 de Maio do ano corrente, para as inscri\u00e7\u00f5es com per\u00edodos Trimestrais e Mensais (sendo dada prioridade aos per\u00edodos de maior dura\u00e7\u00e3o); ser\u00e1 tida em conta que se o pedido for 3 meses mais um m\u00eas seguido ter\u00e1 prioridade sobre os restantes e as \u00e9pocas s\u00e3o tratadas como os restantes pedidos nesta fase;<\/li>\n<\/ol>\n<\/li>\n
        3. a partir das 10h do dia de 9 de maio os pedidos ser\u00e3o atendidos com base na ordem de chegada, independentemente da dura\u00e7\u00e3o per\u00edodo, sendo no m\u00ednimo uma semana; tendo em conta a salvaguardada a disponibilidade de boias para a dimens\u00e3o e tipologia da embarca\u00e7\u00e3o em causa.<\/li>\n<\/ol>\n

           <\/p>\n

          Os interessados poder\u00e3o efetuar as suas inscri\u00e7\u00f5es por preenchimento de formul\u00e1rio online no site www.comportapier.com, preenchendo o impresso de inscri\u00e7\u00e3o disponibilizado para o efeito , podendo endere\u00e7ar qualquer quest\u00e3o para o email info@comportapier.com<\/a><\/u><\/strong>, como tamb\u00e9m enviando depois toda a documenta\u00e7\u00e3o necess\u00e1ria para este mesmo email. Posteriormente todos os remetentes ser\u00e3o informados por esta mesma via, dos respetivos n\u00fameros de inscri\u00e7\u00e3o, dos valores correspondente e a pagar pelo per\u00edodo de utiliza\u00e7\u00e3o pretendido, assim bem como ser\u00e3o indicados alguns condicionalismos, caso os haja.<\/p>\n

          The Management of Comporta Pier and its administrative services will not consider requests from interested parties that do not meet the required requirements (necessary and mandatory documentation), nor those submitted before the date and time set for this purpose.<\/p>\n

           <\/p>\n

          O respetivo formul\u00e1rio, tarif\u00e1rio e regulamento encontram-se dispon\u00edveis, no site da Comporta Pier (www.comportapier.com) e no site do Porto de Set\u00fabal (www.portodesetubal.pt), podendo ser solicitado o envio de toda a documenta\u00e7\u00e3o por email, junto dos servi\u00e7os administrativos do Comporta Pier.<\/p>\n

          3. O crit\u00e9rio de atribui\u00e7\u00e3o ser\u00e1 efetuado por ordem de entrada dos respetivos pedidos, levando ainda em conta os seguintes fatores, para al\u00e9m das diferentes fases dos per\u00edodos:<\/p>\n

            \n
          1. \n
              \n
            1. o per\u00edodo requisitado, ou seja, ter\u00e3o primazia os pedidos da \u00e9poca e os de maior extens\u00e3o por ordem decrescente;<\/li>\n
            2. the characteristics of the vessels \/ suitability for the moorings;<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n

               <\/p>\n

              4. Os pedidos s\u00e3o formulados pelos propriet\u00e1rios das embarca\u00e7\u00f5es ou pelos seus mandat\u00e1rios, nas condi\u00e7\u00f5es previstas no ponto 1 deste artigo, mediante o preenchimento do formul\u00e1rio, que ser\u00e1 facultado por email ou que poder\u00e1 ser retirado dos sites acima referidos, instru\u00eddos com c\u00f3pias dos documentos abaixo indicados:<\/p>\n

                  \n
                1. booklet with valid inspection or registration certificate (and leasing contract, if applicable);<\/li>\n
                2. ap\u00f3lice de seguro de responsabilidade civil e danos pr\u00f3prios correspondentes recibos comprovativos do pagamento (documentos obrigat\u00f3rios), nos termos do Regulamento da N\u00e1utica de Recreio e demais legisla\u00e7\u00e3o aplic\u00e1vel;<\/li>\n
                3. citizen's card\/identity card and taxpayer number (in the case of a legal person, card and permanent certificate);<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n

                  5. Os per\u00edodos de estacionamento ter\u00e3o de ser no m\u00ednimo de uma semana<\/u> que poder\u00e1 ser acrescido de dias soltos; outros casos podem ser vistos por consulta;<\/p>\n

                  6. Para efeitos de correspond\u00eancia e necessidade legal, considera-se como domic\u00edlio a morada e o email indicados no formul\u00e1rio de inscri\u00e7\u00e3o.<\/p>\n

                  7. A atribui\u00e7\u00e3o de lugar s\u00f3 ocorrer\u00e1 ap\u00f3s efetuado o pagamento da taxa de utiliza\u00e7\u00e3o do posto de amarra\u00e7\u00e3o e a atribui\u00e7\u00e3o de boia ser\u00e1 feita no dia do Check-In sujeita a haver altera\u00e7\u00f5es de localiza\u00e7\u00e3o de boias durante o per\u00edodo de estadia.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><\/div><\/div><\/div>

                  <\/p>\n

                  Article 4
                  \nFalse Statements<\/b><\/center><\/h4>
                  <\/div>\n\t
                  \n\t\t
                  \n\t\t\t

                  Without prejudice to other consequences provided for by law, the provision of false declarations by users implies the rejection of the requests made or the cancellation of the authorizations granted.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><\/div><\/div><\/div>

                  <\/p>\n

                  Chapter II<\/center><\/h1>

                  <\/p>\n

                  Boat Parking<\/center>Article 5
                  \nTypes of Parking and Renovation<\/b><\/h4>
                  <\/div>\n\t
                  \n\t\t
                  \n\t\t\t

                  Tipos de Estacionamento e renova\u00e7\u00e3o
                  \n1) A perman\u00eancia de embarca\u00e7\u00f5es no ancoradouro \u00e9 autorizada, a t\u00edtulo prec\u00e1rio, nos seguintes regimes:
                  \na) Estacionamento \u00e0 \u00e9poca: correspondente ao per\u00edodo de 01 de Junho at\u00e9 30 de Setembro do corrente
                  \nb) Estacionamento trimestral: correspondente a tr\u00eas meses cont\u00ednuos.
                  \nc) Estacionamento mensal: do dia 1 do m\u00eas seguinte ou do dia 15 ao dia 15 do m\u00eas seguinte.
                  \nd) Estacionamento semanal: s\u00e3o 7 dias seguidos.
                  \n1) Caso o utente pretenda renovar o per\u00edodo de estacionamento e haja disponibilidade, incluindo eventual obrigatoriedade de mudan\u00e7a de b\u00f3ia, dever\u00e1 apresentar o seu pedido a Comporta Pier, at\u00e9 cinco dias antes do termo da autoriza\u00e7\u00e3o concedida sob pena de, a partir desta data, a fatura\u00e7\u00e3o passar a ser pela tarifa di\u00e1ria, sem preju\u00edzo da aplica\u00e7\u00e3o do previsto no art.\u00ba 8\u00ba deste regulamento.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><\/div><\/div><\/div>

                  <\/p>\n

                  Article 6
                  \nUsage Fees<\/b><\/center><\/h4>
                  <\/div>\n\t
                  \n\t\t
                  \n\t\t\t

                  1.<\/strong> A cobran\u00e7a das taxas correspondentes ao per\u00edodo de estacionamento pretendido \u00e9 efetuada atrav\u00e9s de transfer\u00eancia bancaria para o Iban: PT50 PT50-0033-0000-45663488947-05, Comporta Pier, enviando o comprovativo para o e-mail (info@comportapier.com), at\u00e9 8 dias ap\u00f3s a confirma\u00e7\u00e3o da atribui\u00e7\u00e3o e nunca menos de 48h do in\u00edcio do parqueamento.<\/p>\n

                  2.<\/strong> For non-payment of the fees due, the user incurs the application of the provisions of subparagraph f) of no. 2 of article 8 of these Regulations, as well as the immediate loss of authorization for the mooring post, without prejudice to the holding of the prior hearing provided for in the Code of Administrative Procedure.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n\n\t

                  \n\t\t\t

                  <\/p>\n

                  Article 7
                  \nResponsabilities<\/b><\/center><\/h4>
                  <\/div>\n\t
                  \n\t\t
                  \n\t\t\t

                  1.<\/strong> Users of berths are responsible to Comporta Pier and third parties, under the general terms of the law, for the damages caused, and must use them with redoubled attention and take the necessary precautions in order to avoid the occurrence of accidents, taking into account the risks natural resources to which such activity is subject.
                  \n2.<\/strong> Comporta Pier is not responsible for losses, damages or accidents suffered by vessels and all those who frequent the berths, unless they are attributable to it under the terms of the legislation in force.
                  \n3.<\/strong> Comporta Pier is not responsible for thefts or robberies and acts of vandalism that occur on vessels parked at the berths.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><\/div><\/div><\/div>

                  <\/p>\n

                  Article 8
                  \nRemoval of Vessels<\/b><\/center><\/h4>
                  <\/div>\n\t
                  \n\t\t
                  \n\t\t\t

                  1.<\/strong> Comporta Pier reserves the right to remove any vessel or object parked at the berths when:<\/p>\n

                  a)<\/strong> Parking without authorization;
                  \nb)<\/strong> Parking harmful to the normal functioning of the berths;
                  \nc)<\/strong> The need for maintenance, conservation and operation of the moorings;
                  \nd)<\/strong> The occurrence of bad weather or other circumstances that advise it; without prejudice to the provisions of article 11;
                  \ne)<\/strong> Violation of the rules of this regulation;
                  \nf)<\/strong> Failure to pay the required fees.<\/p>\n

                  2.<\/strong> The costs of removing vessels for the reasons mentioned in the previous number are the responsibility of the owners.
                  \n3.<\/strong> Except in emergency situations or other circumstances that clearly prevent it, the owners of the vessels will be notified in advance by the administrative services of Comporta Pier for this purpose, under penalty of, at the end of the stipulated period, at their expense.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><\/div><\/div><\/div>

                  <\/p>\n

                  Article 9
                  \nSafety<\/b><\/center><\/h4>
                  <\/div>\n\t
                  \n\t\t
                  \n\t\t\t

                  For security purposes and without prejudice to the rights, freedoms and guarantees of citizens, Comporta Pier may adopt, among others, the following measures or measures:<\/p>\n

                  a)<\/strong> With regard to foreign vessels, where applicable, require information on the places of origin and destination of the same, name, nationality, number of people embarked and disembarked, probable date and time of departure;
                  \nb)<\/strong> Proceed with the identification of the people who park the vessels at the berths;
                  \nc)<\/strong> Promoting with the competent authorities the impediment of departure of vessels in justified cases of non-compliance with the established rules.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><\/div><\/div><\/div>

                  <\/p>\n

                  Article 10
                  \nVessel Exchange<\/b><\/center><\/h4>
                  <\/div>\n\t
                  \n\t\t
                  \n\t\t\t

                  1.<\/strong> The authorization of a fixed mooring berth in the event of a vessel being exchanged for another of a higher class of the same holder, will be subject to the availability of vacant berths and, eventually, requests on the waiting list.
                  \n2.<\/strong> However, the holder enjoys, under equal circumstances, the right of preference in the authorization of the berth compatible with the characteristics of the new vessel.
                  \n3.<\/strong> In the case provided for in the previous number, the difference in the rate corresponding to the time not yet elapsed in the parking period is due.
                  \n4.<\/strong> When the vessel is exchanged for another of a lower class, keeping the same mooring post, the rates foreseen for the class of vessel to which the mooring post refers are due.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><\/div><\/div><\/div>

                  <\/p>\n

                  Chapter III<\/center><\/h1>

                  <\/p>\n

                  Obligations<\/center>Article 11
                  \nObligations of Users<\/b><\/h4>
                  <\/div>\n\t
                  \n\t\t
                  \n\t\t\t

                  1.<\/strong> Once service users have taken prior notice of this regulation, undertake to use the anchorage in accordance with the following:<\/p>\n

                  a)<\/strong> request, pursuant to art. 3rd, the assignment of a fixed mooring, indicating the period(s) of parking and the intended anchorage(s);
                  \nb)<\/strong> moor their vessels in the places indicated by Comporta Pier in safety conditions, namely, well moored, equipped with sized cables and in good condition;
                  \nc)<\/strong> be attentive to the weather forecasts posted in the places and especially to the bad weather warnings in order to protect their property;
                  \nd)<\/strong> respect the schedules established for the transhipment from land to vessels and vice versa indicated in subparagraph c) of art. 12th;
                  \ne)<\/strong> respect the rules of good neighbourliness, urbanity and mutual respect among all owners of anchored vessels;
                  \nf)<\/strong> keep the vessels in conditions of perfect buoyancy and in a good state of conservation and cleanliness;
                  \ng)<\/strong> provide the vessels with adequate fenders, in good condition and operational and duly placed, in order to effectively protect them against small bumps and knocks resulting from maneuvers of various natures;
                  \nh)<\/strong> not to harm the safety of berths or other vessels;
                  \ni)<\/strong> not to carry out fires or fireworks of any nature, either inside the vessels or during transshipment,
                  \nj)<\/strong> not to carry out repairs on vessels parked in the liquid area, without the prior authorization of Comporta Pier.
                  \nl)<\/strong> do not navigate at speeds greater than three knots inside the berths, at the entrance or exit thereof, in order not to cause waves that could harm the safety and well-being of other users;
                  \nm)<\/strong> respect the aisles for access and circulation of vessels in the areas designated for this purpose;
                  \nn)<\/strong> not to dump oils, debris or any objects in the liquid area or in the terrestrial areas;
                  \no)<\/strong> not to test engines or carry out any work inside the vessels that may cause discomfort to other users;
                  \np)<\/strong> not cause marine pollution,
                  \nq)<\/strong> do not bathe or dive in the waters inside the berths;
                  \nr)<\/strong> pay in advance the fees provided for in the tariff previously sent via e-mail;
                  \ns)<\/strong> keep updated, no. telephone so that they can be easily and quickly contacted at any time to resolve situations that may arise when parking vessels;
                  \nt)<\/strong> keep the inspections and insurance of the respective vessels up to date.<\/p>\n

                  2.<\/strong> The owners of vessels using the anchorage authorize that their vessels may be changed from a specific mooring to another located at the same anchorage, even without their prior knowledge, whenever force majeure or safety reasons so require, by officials of the service duly qualified and mandated. Whenever there is a need to move a vessel, its owner will be informed of the occurrence and the reason that caused the need to move his vessel, within a maximum period of 24 hours.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><\/div><\/div><\/div>

                  <\/p>\n

                  Article 12
                  \nUser's Rights<\/b><\/center><\/h4>
                  <\/div>\n\t
                  \n\t\t
                  \n\t\t\t

                  Holders of a fixed berth are entitled:<\/p>\n

                  a)<\/strong> ao estacionamento nas amarra\u00e7\u00f5es em situa\u00e7\u00f5es de bom tempo, o qual e em termos estat\u00edsticos se restringe ao per\u00edodo de 01 de junho a 30 de setembro de 2026 incluindo s\u00e1bados, domingos e feriados;
                  \nb)<\/strong> that the mooring where the vessel should be parked is indicated;<\/p>\n

                  Shuttle Service (Transshipment to and from vessels)<\/strong><\/p>\n

                  c)<\/strong> transfer from land to vessels and vice versa every day, at the following times:<\/p>\n

                  \u2022 no m\u00eas de Junho, das 9 horas \u00e0s 19 horas;
                  \n\u2022 no m\u00eas de Julho, das 9 horas \u00e0s 20 horas;
                  \n\u2022 no m\u00eas de Agosto, das 9 horas \u00e0s 20 horas;
                  \n\u2022 no m\u00eas de Setembro, das 9 horas \u00e0s 19 horas;<\/p>\n

                  which is affixed in a conspicuous place on the anchorage shelters. In case of force, the service will be provided whenever requested.
                  \nd)<\/strong> that the embarkation places for the transfer of people to and from the anchored vessels are marked, with the indication \u201cPlace of Embarkation\u201d, that is, the aisles for carrying out shuttle services are identified;
                  \ne)<\/strong> surveillance services leading to the prevention of incidents and\/or accidents;
                  \nf)<\/strong> to be informed of weather forecasts, namely bad weather warnings, in order to protect their property, posted in the support facilities, and in addition, of the respective updated meteorological information bulletin provided by the Portuguese Instituto Portugu\u00eas do Mar e da Atmosfera, including , for the following days.
                  \ng)<\/strong> when carrying out the shuttle service and taking into account compliance with the recommendations and guidelines of the authorities, in the context of the pandemic or other circumstances, the limitation will be made accordingly.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><\/div><\/div><\/div>

                  <\/p>\n

                  Article 13
                  \nCancellation of authorizations<\/b><\/center><\/h4>
                  <\/div>\n\t
                  \n\t\t
                  \n\t\t\t

                  1. <\/strong>Comporta Pier may cancel the authorizations granted to users of the anchorage, without the right to any compensation, whenever they violate any legal or regulatory obligations or provisions to which they are subject or referred to in this regulation.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><\/div><\/div><\/div>

                  <\/p>\n

                  Article 14
                  \nCancellation Processes<\/b><\/center><\/h4>
                  <\/div>\n\t
                  \n\t\t
                  \n\t\t\t

                  Cancellation processes will be officially initiated by the Management of Comporta Pier.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><\/div><\/div><\/div>

                  <\/p>\n

                  Article 15
                  \nSuspension of Authorizations<\/b><\/center><\/h4>
                  <\/div>\n\t
                  \n\t\t
                  \n\t\t\t

                  A Comporta Pier poder\u00e1 ainda proceder \u00e0 suspens\u00e3o das autoriza\u00e7\u00f5es, sem sujei\u00e7\u00e3o a qualquer indemniza\u00e7\u00e3o sempre que, por anomalias verificadas no exerc\u00edcio da atividade, o entenda oportuno, atrav\u00e9s da pr\u00e9via comunica\u00e7\u00e3o por escrito indicando as raz\u00f5es mencionadas no Art.\u00ba 13.\u00ba do presente Regulamento de Utiliza\u00e7\u00e3o do Ancoradouro de Soltr\u00f3ia e os fundamentos de facto e de direito que determinarem a suspens\u00e3o.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><\/div><\/div><\/div>

                  <\/p>\n

                  Chapter IV<\/center><\/h1>

                  <\/p>\n

                  Article 16
                  \nSuggestions and Complaints<\/b><\/center><\/h4>
                  <\/div>\n\t
                  \n\t\t
                  \n\t\t\t

                  1.<\/strong> Users may submit in writing their suggestions or complaints regarding parking or any other matters of interest for the good functioning of the anchorage.
                  \n2.<\/strong> For the purposes of the previous number, we suggest that suggestions, as well as complaints, be made to the email address of Comporta Pier (info@comportapier.com), if they wish to make the complaint in writing, they must make the same in respective complaints book existing in the administrative services of Comporta Pier.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n<\/div><\/div><\/div><\/div><\/div>

                  Chapter V<\/center><\/h1>

                  <\/p>\n

                  Article 17<\/b><\/center><\/h4>
                  <\/div>\n\t
